Handberg announces that Nikesh Ajay Patel (38, formerly from Orlando) has been arraigned on charges related to almost $20 million in fraud that he perpetrated while on federal pretrial release. Patel has been charged with one count of conspiracy to commit wire fraud, three counts of wire fraud, one count of conspiracy to commit money laundering, and eight counts of money laundering. Patel faces a maximum penalty of 30 years in federal prison for each count of conspiracy and wire fraud and up to 20 years in federal prison for each count of money laundering. His trial is currently scheduled for the April 2022 trial term.<br /><br />According to court documents, in 2014, Patel, a Central Florida resident, was charged by the U.S. Attorney’s Office for the Northern District of Illinois for a $179 million fraud scheme. He was arrested and released on bond. For the next several years, Patel claimed that he was cooperating with authorities and using his business skills to get funds to repay some of what he owed. In fact, Patel had devised a new scheme that netted him almost $20 million.<br /><br />Patel’s new fraud scheme involved three parts. First, Patel fabricated fraudulent loan documents that falsely represented that a bank in Miami had authorized loans to be made to convert hotels in rural areas into assisted living facilities. Although the bank in Miami exists, it had never made any of the loans. The person who was listed as signing the loans (“Ron Elias”) does not exist, but was a fictitious identity used by Patel to perpetrate his conspiracy and scheme. Second, Patel applied to the United States Department of Agriculture (USDA) to guarantee the fake loans pursuant to its Business and Industry Guaranteed Loan Program. Third, after the USDA agreed to guarantee the fake loans, Patel sold the guaranteed portion of the fake loans to the Federal Agricultural Mortgage Corporation, also known as Farmer Mac. <br /><br />Patel executed the scheme on three occasions, receiving almost $20 million in proceeds. She said that his wife was the youth leader at her temple, and that her family spent a lot of time at the Patel household where most of the abuse occurred.<br />The first incident happened during a dinner party that her family attended at the Patel home. She and her brother were watching a movie in Patel's bedroom when Patel entered, went into a walk-in closet and told her to join him. Inside the closet, Patel instructed the girl to touch his penis over his clothing and told her it was his "Jolly Rancher."<br /><br />Another time, when the girl was 8 and she and other other children were at Patel's house, Patel called the kids into his basement to play games or watch a movie. Once downstairs, Patel called the girl over to him and from behind a wall, placed his genitals in her mouth.<br /><br />Another time, he tried to penetrate her under a blanket while watching a movie. He also gave her a cell phone when she was between the ages of 7-9, and asked her to make sexual videos of herself.<br /><br />"(She) was afraid that by coming forward to tell her story that her family would suffer because it would hurt their standing in the community," an FBI agent wrote in an affidavit.<br /><br />Then came accuser number two.<br /><br />On Sept. 11, 2020, the FBI interviewed a 23-year-old woman who made similar allegations about Patel, saying he sexually abused her when she was a child in his car, at his home and at the temple. As the owner of a donut shop and ice cream store, Patel often drove children to his businesses for treats, she said. <br /><br />The second accuser said that when she was in seventh grade, Patel put his hands down her pants while he was driving her in his car and inserted his finger into her vagina. She pulled away and he stopped. When she turned 16, she said, he regularly touched and grabbed her breasts and buttocks at temple.<br />The last time he touched her, the second accuser recalled, was in October 2019. She was working in the temple kitchen when he grabbed her breasts and buttocks. She told him to stop, and he smiled.<br /><br />One month after accuser number two came forward, the Canton police obtained a warrant and searched Patel's Canton residence, where they found a sexually explicit video of accuser number one on his home computer. Police say he’s been messaging young teens again, trying to offer them money for sex.<br /><br />“He was just on social media, trying to talk to people,” Merritt said.<br /><br />Investigators say he contacted at least three teens at Whiteland High School. The teens said they didn’t know Patel, and that he found them on Instagram.<br /><br />According to documents, he messaged one teen saying: “Hi. I am looking for fun” and “As we meet you get cash.”<br /><br />Court records show a detective used one teens Instagram account and engaged in a conversation with Patel. Then we felt a sense of fraud by you by putting blind faith in you. Then after our involvement we got to know that you even took a loan of over $100,000 from the bank without our knowledge. Was taking a loan necessary even after we gave you full amount?<br />We came to Canada and for the month of June and July 2014 I (Madhavi B. Patel) was given 100 hrs/week without salary and was told that it was training.
